On June 2,
2008, the Ontario Minister of Tourism (the “Minister”), on
behalf of the Ontario Minister of the Environment, confirmed the
Decision by the Director of the Environmental Assessment and
Approvals Branch of the Ministry of the Environment (the
“Director”) that an Individual Environmental Assessment and
mediation were not required for the Project. On July 22, 2008,

one stakeholder of
the Project filed an application in the Ontario Divisional Court for a
Judicial Review of the Minister’s Decision. Although the Minister
is the primary party to these proceedings, we will take all necessary
steps to ensure that our interests are represented in these legal
proceedings. The courts are generally reluctant to overturn Ministerial
actions such as the Decision.
We have
submitted the required Statement of Completion to formally conclude the
Environmental Screening Process and we have received
an
Implementing Order from the Ontario Municipal Board,
which provides the necessary approval from this authority. As well, the
Ontario Energy Board has issued an order granting a Leave to Construct
to the transmission line. We are following the established process and
will proceed with the Project. This process includes the acquisition of
other required permits or approvals as appropriate within the Project
timeline.
As with all of our plants, construction and operation of
Wolfe Island Wind Plant will be undertaken in a responsible manner that
is respectful of the environment and the community.
It is business as usual
for Canadian Hydro. We continue to work through obtaining our final
permits in efforts to build a responsible, sustainable wind plant on
Wolfe Island. As the environmental screening process has been completed
in a fair, open and transparent manner, with input from various
stakeholders, we have addressed all concerns appropriately through the
process and continue towards construction.
